Thousands of construction workers have had their lives turned upside down. The problem? Workers claim that they have been blacklisted for making health and safety complaints against employers or joining a trade union. Joining a trade union, and making health and safety complaints, isn’t illegal.

In fact, it’s encouraged by some as a way to ensure the safety and fairness of construction workers. However, according to some, this activity is being met with retaliation inside the industry. The blacklist, if it exists, is illegal and would be investigated by authorities. Right now, allegations are being made that police, and certain security services, provided information that was used to compile the list. It has reportedly been used on several high-profile projects like the Olympic Park.

If it is discovered that police were indeed involved, the government would step in to ensure that justice was being served for construction workers. The blacklist company, the Construction Association, has allegedly been maintaining a list and selling it to construction companies as a £3,000 per year subscription plus a £2.20  fee per blacklist check. The blacklist isn’t official, of course, and MPs and trade unions are being asked to present evidence for it because innuendo isn’t enough for the government to take action.

Christian Khan solicitors, who represent the Blacklist Support Group, have submitted a complain with the Independent Police Complaints Commission and the Met. However, the complaint was never filed because the IPCC claims it was too general.

Sarah McSherry, a partner at Christian Khan solicitors, told Building Magazine, “The complaints process is the only forum in which criminal allegations against police officers can be investigated yet the [Met's] directorate of professional standards refuse to record the complaint, suggesting that our clients ‘should report the matter as a crime in the normal way’ as the ‘complaints process is not the correct vehicle to forward their concerns or allegations.

“This smacks of a complete lack of knowledge of the Police Reform Act and indeed the very function of the directorate of professional standards.” McSherry added that they would be appealing the decision.”

It’s reported that more than half of the country’s leading construction companies were using the blacklist services of the Construction Association in 2009 when the operation was shut down. Many of the construction workers on that list were forced out of work and into destitution because they were unable to find a job.

The information commissioner has carried out the original investigation. So far, what’s being uncovered is alarming. According to David Clancy, its investigations manager, some of the information recovered from the Association could only have come from police of security services.
